Anyone with even a rudimentary knowledge of American history knows that white settlers steadily seized Native American lands over the course of several centuries in order to build the United States. But what’s not so well-known is that a version of that same land grab continues to play out today.

Prayer in Intervention FRCP 24 for Independent Review and Appraisal


To The Honorable Judge of Said Court,

Now Comes Judson Witham , Son of the Swamp Fox …… who would show as follows:

1. This entire lawsuit derives exclusively from — “The Ouachita Timberlands of Southeastern Oklahoma: Unextinguished Choctaw-Chickasaw Indian Title and Unconstitutional Corporate Real Estate Holdings” — as documented by Richard Hayes Phillips a Student at University of Oklahoma, 1982.

2. According to an article by Richard Green, posted on the official website of the Chickasaw Nation, “it was serious scholarship, dogged investigative reporting, and contained plenty of information critical to the case.”

As stated in the article, in April 1982 Mr. Richard Phillips presented his findings to the Choctaw Tribal Council, which “unanimously passed a resolution to pursue a claim to regain alleged Choctaw properties unallotted contrary to federal law. … Choctaw Chief Hollis Roberts instructed the tribal attorney not to pursue the case and that is where it stood, in a state of suspended animation, until 2005 when (Chickasaw) attorney Jason Aamodt found and photocopied Phillips’ 185-page thesis.”

4. Upon Information and Belief ….. The facts underlying these wrongs were never disclosed to the Tribal Members of the Desendants of the Allodial Title Holders of said Lands. The Members of the two Indian Tribes were not informed nor consulted of the unlawful conversion of Their Lands from whence they were removed and to where the Indian Reserves at the heart of this case were immorally converted.

5. Now that the Chickasaw and Choctaw Nations have won the factual and equitable rights the land claims and the accountings of lost revenues and royalties associated with the unlawful conversion of those properties, a fair valuation of the deprevations is certainly in order.

6. At this time the facts of the wrongful removals and conversions of the Natives properties are nolonger in dispute.

7. The unallotted Choctaw-Chickasaw timber lands amounted to 1,373,324 acres. The final settlement is expected to amount to hundreds of millions of dollars. The reality of the actual value of the land , minerals, timber , water and surface of the lands far exceeds the rumored settlement amount of $187 Million Dollars.

8. If actually tabulated at current market values the $187 Million amount would pale in comparison to the actual value of compensation that is equitably and morally owed to the rightful owners of said lands and appurtenances. 
9. Actual and Punative Damage Awards are within the sound pervue of this Honorable Court and should be taken into consideration considering the magnitude of the wrongs described herein that are NOT IN DISPUTE.


II.
Prayer for Independent Appraisals


1. The United States of America, Washington, DC by and through the United States Department of Interior has an obligation for a fair accounting and valuation of that wich has in this matter been immorally and unlawfully converted.
2. Your prevailing Parties to this action should be held to aquire independent appraisals and establish factually what the actual vale of the stolen lands and resources is actually worth and derive from that the consequential damages to the Tribal Members of both Indian Nations. 
3. The extensive harm done from the removal of these People from Their Tribal Homelands in the areas of Tennessee, Alabama, Mississippi, Arkansas and parts of Missouri etc., The actual damages suffered by the Individual Tribal Members far far far exceeds the sum of the current proposed settlement.

Chickasaw-Choctaw Claims Against United States Bolstered by Master’s Thesis

Scholarly works of history by graduate students usually never amount to much– except in the scholar’s fevered mind during the university-sponsored baptism of fire that constitutes the development of a thesis or dissertation. Such works normally take one to three years to complete.

The academic requirements for developing such a work are so rigid, narrowly focused and reader unfriendly that the majority of these book-length history manuscripts are never published. Most gather dust on a library shelf at the universities where they were produced. Although they can be checked out, few ever are.

This article, however, is about one twenty-five-year old master’s thesis that was plucked from obscurity last year during legal research for the Chickasaw and Choctaw nations. The thesis has been a crucial source of information in the preparation of the tribes’ joint claims against the United States, alleging failure to account for the management of tribal assets spanning the 19th and 20th centuries.

Governor’s Timberland Concern

After he became governor in 1987, Bill Anoatubby learned that the vast Choctaw-Chickasaw jointly held timberlands in southeastern Oklahoma had been sold in large parcels by the federal government to timber companies. He wasn’t able to determine specifics, but was disturbed by the bits and pieces of information that he knew. He suspected collusion between federal employees and the timber companies likely had occurred.

Wherefore premises considered taking into consideration the violent removal and forced Military removals at the end of a Sabre, Cannon and Rifle ……… The claims for the ACTUAL DAMAGES caused by the unlawful conversion of the Tribal Properties should be fully and completely apparaised and evaluated by Independent Human Rights Entities to establish the actual damages inflicted by the particularly egregious conduct of the United States of America in these matters.

It is therefore requested that independent investigation and evaluation of these claims be ordered by this Honorable Court. Said Court and the United States owes a great debt to the Peoples of these Native Peoples in the instant case and Generally across the Americas.
